Looking for a sanity check. My company is currently withholding my commission check until I sign a new comp plan. They also don’t seem to understand that the new comp plan can’t be used to impact already closed deals the way our contract is written. Is it time to lawyer up?

    Probably time to sign a new comp plan, get your commissions from previous comp plan, then leave. Don't you think? Also be sure to share this experience on glass door so people are warned.

  • Withholding commission is an hr issue, regardless of who writes the plan.

      Very strange that nobody finance, payroll, sales management or HR has stepped in to paid out commission based on "new" plan. Some states won't even allow withholding commissions from Termed EE's.

    Without knowing all specifics (company size, your tenure, reason for comp plan change and its introduction) I go straight to worst case scenario: that CEO is informed and you’re on the outside being gamed. Once you get a reputation at companies that play these games, they go after you.

    I’ve never seen it end well. Sign, collect, leave.

    HR isn't usually involved with #sales Comp Plans or helping you negotiate position on new plan. Finance teams are usually the ones who create new/ weaker plans.

  • Call a meeting. Include hr, Manager, skip manager, and more. Make the meeting at 430 on a Friday so they want to get out the door. Then demand resolution and tell them you are filing a state Dept of labor wage complaint. Then collect.
