Is unjustifiable PIP considered harassment?

Consider the following (if possible, from a legal and unemotional perspective):

- a totally unjustifiable PIP
- manager creating a “toxic” work environment for you specifically
- lying about performance
- threatening a poor performance evaluation
- threatening to fire

All done with the intention of getting someone so demotivated and afraid that they quit by themselves or get fired.

Is this considered harassment?

Most documentation for harassment seems to be related to protected classes (e.g. race, religion, etc).

But I would think that there’s other forms of “harassment” besides that of protected classes.

    You should start looking for a new job now.
    But before you put in your notice complain to HR and create a fuss about your Manager that you were constantly being mentally harassed.

    If you are doing wfh, it's easy to record the conversations.

    You might not stand a legal group but a good way to get back to your manager and cause him some trouble and rip him of his reputation in the team/company

    There is no way to prove it unless you made series of complaints on discrimination or harassment before the incident.

      Legally it would depend on the state.

      As I said, harassment is a legal term defined by the law in each state individually.

      Whether it’s “morally” something that should be allowed is a different story.

    It is constructive discharge which if you can prove it makes your quitting equivalent to being fired. In an at-will state that doesn't buy you much. Wrongful termination in CA is only for protected class discrimination or retaliation. Fire vs quit also affects unemployment eligibility. IANAL
