Hi Blinders! My H-1B started during Oct,2019. I plan to file a H-1B transfer soon. (currently interviewing) Will it be okay to start the I140 process via my current employer? Or should I wait for the new company to start the green card process? My concerns are - 1. The company I might end up accepting offer is a management consulting and might have at least 1 year employment with them rule to file a green card. 2. The process of finalizing the job offer and visa transfer might take more than 3 months in which I might get a good step 1 start with the current employer. Any advice? #h1b #perm #rfe
It will take atleast an year to get i-140 and your new employer will anyway have to start the process again as they have to file a new labor and PERM again and it is not transferred

Got it. Sadly I have not started the perm process at all. I should change my subject. My debate is to who should I get started with?
It takes at least 1.5 years for the entire i-140 process to complete. So, you have to be for so long with any employer you wish to get i-140 from. Also it is best to stay 6 more months after you get i-140 to lock your PD. So, don't worry about it if you really like your next employer. Make sure you ask your new employer what their policy is. For example Amazon doesn't start i-140 process immediately AFAIK.
And after that also 6 months as they can pull it back

I have similar concerns and am in the same boat as OP. I have my h1b approved since Oct 2019, and are yet to start (by feb) my GC process. I am planing to make a switch in mid 2020. My current employer will most likely go the Premium Processing route, hence I am not sure what the situation will be by mid 2020. My questions are: 1. Should I get started on PERM filing with my current employer ASAP keeping in mind that I may wanna switch in 6 months? 2. If the answer to 1 is yes, when can I expect to have an approved I-140 assuming its done via PP? 3. Similarly, what parts of my GC application would have to be redone if I switch after receiving my I-140, if I move to a different employer? Also, can I move/switch immediately after receiving the approved I-140? Thanks a lot for helping out with suggestions and advice folks!
Perm doesn’t have premium processing. usually takes 4 months. There is a pre process before perm where your employer has to try recruiting US citizens and collect proof that no one made it. This process takes 90 days or more. 140 can be done in premium. Every time you change the employer, perm and 140 have to be re-done. Only thing is, you can port your oldest priority date to the newer 140 filing.
Thanks for the response! So basically the only positive of applying right now would be the priority date carryover. The negative would be that the process would be more complicated since I’d have two PERM and I-140 apps, and would have to switch just after getting I-140 which in itself isn’t advised. From the timeline you suggested, it appears that if everything goes will it will look like: - Feb 2020 to Apr 2020: company initiates process for advertising job vacancy and collects proof no one made it. - May 2020 to August 2020: PERM filing and approval. - September 2020: I-140 initiated via Premium Processing. Does this look correct? Can you elaborate on when can I safely switch after I-140 is approved? Thanks!

Uhm, I have not applied for perm at all. I just got my H-1B and debating who should I start with? Current employer(I will be with them for next 3 months at max) or the new employer.
