Why h1b doesn’t have country cap, but green card does?

How come the H1B visa doesn’t have country cap while the green card does? Does that mean the US wants to use talent regardless country of birth but turns unfair when giving people residence ? I have heard already heard the answer “Oh h1b visa is a temp VISA we don’t need diversity there “. That’s just plain BS, h1b is the reason why we have so many Indians in the US in the first place and have huge backlog for them. Would like to hear some sane answers.

It’s not the us but the liberals who don’t want you here unless the illegals get blanket amnesty. If not for the liberal blackmail, hr392 would’ve been a law by now and you’d be in the fifo gc queue irrespective of your country of birth (a true merit based system). Ironically, the Indians continue to sing praises of democrats when all the democrats consider them as a poison pill for any (IL)legal immigration reform.

GC is the carrot that keeps the H1B slaves working. Loss of status is the stick. If you let the donkey eat the carrot, you won’t be able to overwork it. Corporate America doesn’t want to give away the carrot so easily. Maybe just a little bit so that other donkeys can see that the carrot is real.

Countries act and should act in their own best interest. The US government does not believe it is in its best interest to give permanent residency to too many Indians but thinks it’s in the country’s best interest to have lots of Indians on H1-B. The question of fairness comes up when you’re entitled to something and do not get your FAIR share. Indians(or any other immigrants) are not entitled to anything from the US. The question of fairness might have been raised if Indians were/are getting manipulated into shitty deals, but that is not the case. People know the consequences of their decisions and choose to take the ‘Shitty’ US H1-B deal over whatever the governments of their country is offering. Let’s not pretend that there’s some bullying or manipulation going on here. PS: It doesn’t matter why they choose the decisions they make. Countries should have a right to autonomy and part of that is making decisions about your country and not owing any other country an explanation. I’m an immigrant and I think the US immigration system is inefficient and does not work in the best interest of the country, but to call it unfair is a stretch, and to claim that I could not be wrong about an issue so complicated is just plain ignorant.

But there is no country cap for H1B. All 65k+20k masters quota can be and most always are Indians with some east Asians and handful of rest of the world..

After 65000 applications it’s switched to a lottery system. Of the 94000 applications in the current pool they will be randomly selected.

Govt. wants more tax $$$. Folks on H1B are paying one of the highest taxes. In return govt owes them nothing (no social security etc). Also to get votes politicians can say they controlled immigration by screwing H1B.

H1B is for temporary labor. Green Cards are for skilled workers in demand. Lookup the requirements. H1B is not for talent, it is for anybody: cooks, etc.

Think of H1 as non-immigrant (even though it is dual intent) and Green Card as immigrant visas. H1 is NOT a prerequisite for GC, however it is often used as a path to GC. To answer your question about why there is no per country limit for H1-B: H1 can not create uneven immigration. Again, H1 is for 'work 6 years or less and go home' type of visa. And GC is for permanent residence (you leave country for prolonged amount of time and you lose it).

H1B is a way of making white collar slaves. I have seen people in my company who are made to work crazy hours with immense pressure. And they keep working like that because the visa is tied to their presence in the U.S.

I find the diversity visa program unfair(details below). This gives 50,000 visas away to completely random people from countries around the world except India and China annually. You don't even have to be in the US already to qualify for this or have to have any qualifications.
