Has someone you know received a written warning? Is it serious? Does a company keep a permanent record, and if so, who can see it? While I was on maternity leave, a senior leader complained about me. I just returned from maternity leave, and I was given a written warning. I know the incident violates the Pregnancy Discrimination Act, but I feel that I am unable to go to the ombudsman out of fear that it will be escalated to my VP -- who complained about me. I am also afraid if I protest the warning, Ethics & Compliance will accuse me of retaliating.

The warning was about a perceived conflict of interest (not actual or potential COI). While I was 36 weeks pregnant, I disagreed with a senior leader on his judgement call because I am the technical manager and I knew more information. He yelled at me in front of three other colleagues saying, "Who is she?! What authority does she have?!...I have been here three days...you haven't even walked the site..." He falsely assumed that I was not walking the site because I was 36 weeks pregnant -- but I WAS there and have video evidence and eyewitnesses. He then complained to ethics & compliance while I was on maternity leave that I was "unprofessional, deceitful, and disrespectful" and my decision must have been due to a conflict of interest. This man twisted the facts of the situation. Ethics & Compliance also searched my email and found an email that I sent that said "I'm proud! :-)" implying that I was creating a perception of a conflict of interest.

What was the complaint about? Your absence? Lawyer up and threaten legal action. Collect settlement. Move on.

Escalate, otherwise this toxic person may continue this bad behavior. If you are leaving, kick him in the balls.
