Finding a new job during H1B grace period

Jun 16, 2021 37 Comments

Posting on behalf of a friend on H-1B who was fired from Amazon (and therefore cannot join Blind now to post this by herself).

Question: can you accept offers from multiple companies and initiate H1B transfer with all of them at the same time? Any potential problems this could cause (apart from being blacklisted by the companies she doesn't end up joining), and is there a limit to how many of these applications can be filed in parallel?

Background: Her 60 day grace period is ending in about 3 weeks. The good news is that she had started preparing for interviews when she was notified of PIP. So she's managed to complete a few of these on-sites and has verbal offers from 3 companies right now (all of them over the last few days). She is tempted to simply accept all 3 offers and have them all file for her H1B transfer just in case one or more of them gets denied or delayed for whatever reason. It's only once at least one transfer is approved will she truly be out of danger.

So morality aside, is this ok to do? Has anyone been in a similar situation before?

My TC 370k, YOE 4

Having multiple employers apply for her transfer is not a problem.

Isn’t that impacting someone else’s chance via their valid H1B application? I’ve seen so many people having to relocate because their case did not get picked and other hand, we have cases where people apply multiple times.

While it's tempting to file multiple, I would pick the best of the 3 and have them file asap with premium, so you know the decision in about 10 days. This isn't like filing multiple fresh H-1Bs to improve odds..It may not be worth the risk & effort to file multiple. If that one application is genuine, it will be approved and your friend has no reason to be antsy.

Also look into the track record of the immigration company filing the visa app.

That's actually something we discussed. But our biggest concern isn't actually the odds of approval - she went to a top 20 school and has worked at a reputable company (Amazon) so we're not really worried that the application may be rejected.

Instead, the biggest concern is the speed at which these companies move forward. She needs the application filed (but not necessarily approved yet) before she can start working, and she needs to start working within 3 weeks (ideally 2 weeks to have some buffer). So it's all about which company moves the fastest with background check, LCA filing, and then H1B transfer filing. Accepting offers from 3 companies will increase the likelihood that at least one of them will meet this timeline.

She has a high chance of getting rfe if multiple LCA gets approved.

    • Dont give false/incorrect replies when you dont know the rules, you can have 7 h1bs filed at the same time. Rfe nd rejections have nothing to do with how many h1b are filed

@kaptand1 - is 7 the actual maximum number of H1B transfer applications one can have filed at the same time or were you using an arbitrary number to make your point? If it's the former, I'd love any pointers to the official documentation for this rule.

It's too late to start applying for new companies now since she has such limited time left. But certainly appreciate the gesture, thank you.
