How does visa status affect hiring decisions

I am just curious about recruiters and hiring managers thoughts on candidates visa status.

Assuming two candidates cleared the interview for a position. One on H1B and the other is a US citizen.

As a hiring manager who would you prefer having on your team?

As a recruiter, would you filter candidates based on visa status at all?

  • Hiring manager here. I don't know this information when making hiring decisions, so it never enters my decision process. If two candidates cleared the interview and have similarly relevant experience, I take the first one who signs the offer.

    Same. In 20 years of interviewing at both FAANG and Non-FAANG companies, the visa status did not show up in not even a single interview debrief.

    So I’d say, it does not matter.

  • Its illegal to discriminate based on nationality/country of citizenship. As long as the person has legal rights to work on the position at the location (which the recruiter should have verified) the hiring manager does not need to care or know about this.

    • People of different nationality most of the time has different nation of origin (except the small percentage of natuarlized nationals).

      This means, not only does title vii protect people of different nationality, it also protects people of different national origin.

      People of racist behavior like you, however should never be protected under any law.

    What nobody mentioned yet is the “unconscious bias”. For example, if a team travels a lot to let’s say China, the manager *might* be inclined to hire a person not on VISA as it will take most of the visa issues out of the way. True that the manager doesn’t know the visa status of the candidate, but it’s not too hard to *guess* from the candidate’s accent, the schools they went to, etc.
