I recently accepted an offer and they started working on my H1B transfer. However, since my perm was filed to by my current employer, they advised me to wait till it’s approved. Ideally it should be approved by May. I told them to move ahead with filing they transfer to reduce the joining period once my perm is approved, however since then I have not heard back from attorneys. I feel it’s weird for them to not respond and at all, it has been over 5 days. Wondering what should I do.
Follow with them ? Contact recruiter ? I have no idea what’s going on.

  • If its big law firm like fragomen, you have to basically beg for the response and keep pushing them to get anything done in timely fashion

    If you want 140( needed for H1B extension beyond 6 yrs) then stay until you have it done by current employer. If you are not in the edge of H1B quota of 6 yrs then move to new employer and ask them to kick of Perm/140 .

    2. Getting PERM approved without a i140 is not gonna make any difference. You will have to start your PERM again and get a new priority date without an approved I140. Try to get on a call with the attorney from new job and ask them this

    • I did not apply, recruiter reached out to me and I just went through the interview process, was not even sure if I would get a job haha
      When the attorney told me about i140 then I thought about it.

      Exactly..you need to research and do homework before... immigration stuff is not instant irrespective how big your company is . You are looking at atleast 5-6 months for your i140 and also your current employer can withdraw i140 if you leave within 6 months

    You do know that you have to work for the company 180 days after I-140 is approved to avoid being revoked right?

    • Yeah, but companies generally do not revoke it in good faith. I heard it’s done in cases when you burn bridges. It’s costly to do it so they just don’t do.

    OP. Why did they ask you to wait for perm approval?? Are you close to maxing out your 6 year limit??

      Got it. Their worry is not able to get 3 full years. Hence asking you to get perm approved. But I don’t see it might help them in anyway as you need to complete 180 days after i140 approval to cover you under AC-21.

      You should decide what Is your priority. You want to get a pd and fall under AC-21 to get unlimited extensions and transfers or join new employer with less than 3 years of h1 and start gc process.

      Joining new employer without i140 is a risk if you ask me.
