H1b transfer while amendment/extension in progress

My current company filed an amendment/extension under regular processing for h1b on January. I got an offer from AMD but their legal team doesn’t want to file h1b transfer till the amendment is completed. But, according to some sources I found online, I think AMD should be fine filing a transfer. Isn’t this true?

Any suggestions should I ask my manager to upgrade it to premium, or ask the new company?

    If you have an existing petition with USCIS - your i94 is bound to change and if you have transfer petition filed at the same time - the second petition will be converted to counselor processing meaning you have to leave the country and come back using the second approved H1B to work at your new company.

    My suggestion pay the $2500 and get you extension upgraded to premium and then let H1B transfer go through. That’s what I did.

      Once I told my amazon attorneys that my transfer is filed by my old company and that I upgraded to premium - they waited 3 weeks to file my transfer. They used the new H1B in the transfer petition. Upgrading to premium is 1 page simple form and can be done in 1 day.

      Also if you want a second opinion, get your own lawyer. Don't listen to strangers who have no interest in your outcome and whose information you cannot double check.

    I don’t want to get my own lawyer just for an opinion. I wanted to see what people might have gone through, taking the responses with a grain of salt
