Is it EB2 for someone with MS in CS?
I am not a lawyer. They did eb2 for me, without a us(or any masters) and a non CS bachelor's(foreign). So I am sure their are other factors they take into consideration. I have also seen cases which guys with PhDs(European) and 100s I papers and 1000s of citacitions where out into EB2. Yes, overall msft plays a bit conservative.
If you are Indian then it doesn't matter
Even if you’re eligible for E2, Microsoft will file E3 unless you have a Master. That’s the rule, but each case is different.
Mine is EB2 and I have a masters 4 yoe
They do EB3 for 59 and 60
I managed people for many years at Microsoft and filed several people’s GCs. Mostly, if you have a relevant Masters degree, you will be categorized into EB2. If you have more than 5 years of experience BEFORE joining MS and have a CS or related bachelors (undergrad), you may qualify for EB2 as well. Nevertheless, it is at manager’s discretion, because the job may not require a masters degree and hence you could be categorized into EB3 despite the first two items I mentioned. However, most managers understand the pains of GC process and will try to do what is best.
