Long term employee. International transferee. What happens if I change firms before filing i-485 (before it is pending for more than 6 months)? Do I need to apply for eb2 or eb1 again?
your new employer has to file your case in eb1 retaining priority date.
You sure? Isn’t EB1 international transfer case s only. I would love if this was true but wanted to double check.
What visa do you use? H1B? I’m not sure about eb1, just because you’re likely a top manager (or supposed to be). In case eb2/3 changing job is pretty straightforward process.
EB1C? You can’t change employers till you you actually get your GC and then some.
What is the backlog in your case? I would stick to current employer. Keep in mind, new employer will not start gc process from day1.

You can't apply for EB-1C with a new company unless you leave the US for 1 year to work for that company first. If you go to the new company then you do have the option of filing for EB-2 or EB-3 while retaining the priority date from the EB-1C I-140.

Yeah sorry, if you need to be able to continue in EB-1C then you should just stay at your current employer until you can use I-485 portability

What did you end up doing? I am in the same boat as you. I-140 was approved two years ago and I-485 will be current in a month or so but I am getting laid-off now. Can you please share your experience and is there a way we can fight this out with the USCIS as we were not allowed for concurrent filing in 2018 otherwise we could have used the AC21 portability option just like the people who filed in 2017?
