h1b transfer

I am in the process of transferring my h1b over to new employer. Immigration lawyer said that I can start working once case is filled however, I have heard horror stories of visa troubles when transfer gets denied but you have already left/ given notice at your old job. Is it ok to tell recruiter to push my joining date after visa transfer is approved?#h1b

    My 2 cents - never join a company just on receipt number, if you are joining if somethings happens to the visa you may have to leave the country, employers usually take care of these issues and well aware of the process etc but you never know things can change anytime.

    I am currently in the process of visa transfer too got an RFE, attorney told I am good to join new company since I have receipt number but I told I won’t join until my visa is approved and my recruiter and hiring manager were ok with it after explained the risk. Make sure you talk to the recruiter and the hiring manager about the risks. They should be ok

    Definitely do not join before the transfer is complete. Don’t go from 100 to 0 in no time.

  • If they want you to start sooner then file for premium process.
