Visa question : Can i join a new company when I am outside the US

Jul 23, 2021 5 Comments

Hi everyone,

I have accepted an offer from another company. I plan to travel to my home country before joining the new company to take advantage of the PTO in my current company.

The new company has virtual onboarding. Can i join the new company from my home country after a visa transfer through virtual onboarding ?

Has anyone done this ? Do I need to travel back to the US to join the new company ?

I have a valid visa stamp and I-94.

If you have a valid H1B stamping you do not need another visa stamp, even though you change your employer.
However please note that there are some travel restrictions for H1B holders.
You should discuss with your new employer if you can work from India for an extended period of time. Some companies (like Amazon) does not allow you to work for more than 15 days from outside USA.
    Good luck.

I think it’s possible to switch. Talk to an attorney on this.

  • You can definitely do what you described, however, you will need to get the new visa stamped on your passport before trying to enter the US.

This is assuming the consulate in your home country is open and has appointments available.
