I have seen posts about raise in h1b salary thresholds that has created panic in me and my friends. Here is a small correction that many of us are confused about

The Leveling in LCA is not reflective of your personal experience. It has to do with job description.

LCA is filed for a particular job position and it’s not reflective of individual. I saw my LCA and confirmed.

That being said, I have been in L4 (level in LCA) for the past 8 years span and I can be at L4 for the next 10-15 year span as long as the job Minimum Requirement says

“Bachelors + 2 years experience” . I emphasis on the minimum and not preferred .

I know a 30 yoe developer who was hired in one of the teams and had only bachelors. They toned down the job experience and hired him . He was American citizen and he is more than eligible for the job so I do agree with that decision.

I only see the issues at entry level . Students will not be eligible to apply for h1b in the first 1-2 years.

So most of the folks who got degrees in USA will be going back homes because of lottery and many who are not educated in USA will get a lottery and come to USA .

I frankly do not understand how this will save jobs as I do not see this helping anyone in near future

  • If you all are suggesting to start filing at a lower wage level, then understand that it's gonna raise suspicion. For 10 years filed as l4, and now suddenly reduce it to l1/l2 during renewal. USCIS might not like it.

    The only way forward is for the rule to be struck down by court or change of president after election.

      The level is the job description not your personal experience. It’s totally fine as every job description says bachelors plus 2 years most of the cases. Lowering the level is basically make you seem over qualified.

      Since the worry is about under qualified workers, i think uscis can take it

  • I hope faang can come up with a law suit or waiting for election results? Not sure if it’s possible. All lawsuits had been filled by consulting companies

    I am really bummed because of this. I graduated and got a job at Amazon snd thought that H1B will be taken care of. And now this happened. Sucks.

      Ok when I said it might affect entry , I am sure Amazon kind of companies will take care of it. I have 5 interns joining next year and everyone will be on the same salary range

      I would be worried if I am going for consulting companies or something of That sort

  • In addition, if it's a manager role and the prevailing requirement is to have 5 years of minimum experience, then too it can be L1/L2, since the level is calculated based on how much above the standard requirement is the job description.
