EB1 Green Card

What exactly is the criteria for filing for perm under EB1 category? I have read through the criteria on immigration website multiple times but I also know of a number of people who don't fit any of the criteria yet have already received their green cards under EB1. The reasons I hear from them are pretty lame - my title has Manager in it so my company files it under EB1 (if that really worked, all PMs in Msft would be eligible under EB1), I had vendors directly reporting to me in a previous project even though I was never technically a people manager, etc. Is there a big grey area and is it being exploited by some companies and not others? This is frustrating especially for Indians and Chinese who earned a graduate degree in the US and are stuck in EB2 queue for years. What is the way to get into the EB1 queue??

  • EB1-c is perhaps the worst loophole in the immigration system. Worse than h1-b abuse imo

  • Two options , EB1B publish papers in your field which others will cite and use . Make yourself known in research community so that researchers across the globe can write recommendations for you . Become editor / reviewer of peer reviewed journal / conference. Other option is to move to India , join CTS and after a year come back as EB1C manager :-). Pick your route

    • That's what I thought. The first case makes complete sense. The second one is like a loophole and a slap in the face for folks who take a lot of time, money and effort to study here, graduate and get jobs. And then someone who was with you in india and had failed 5 subjects and yet got into CTS comes by and gets the green card under EB1, just because his company has zero hiring standards and is willing to make anyone with people skills a manager.

  • You need to have reports to be a manager. pms do not unless they are actual managers

    • That's what the rule says. And yet, I know folks in other companies who have got their green cards under EB1 in spite of not having direct reports, just because their title contains the word manager.

      Hint: This is the company that can form any words since the name of their parent company contains everything they need to make a word.

    • PMs at Microsoft can have vendors (US and abroad) reporting to them. That plus the manager in their title seems to be sufficient for an EB1

    It's not a loophole. It's published by the authorities as a way to get a GC. The rule is stupid, I agree. They want to burden engineers on L1b and H1b to provide proof of specialized skills etc. and put them in an endless queue, but allow a "manager" who probably didn't even put in half as much effort, or probably was a mediocre engineer, to get GC easily.
