Annual performance review and FMLA

I have been with Qualcomm for a bit over a year. Unfortunately I had a family member who was sick and passed away. Since I didn’t qualify for the federal FMLA due to being at the company for less than a year, I had to use company’s own benefit called Family Time Off (3 months) after providing medical evidence. and then I took my 3 week bereavement leave which is also a company benefit.

Now time has come for the annual review and the boss is being a prick:

1. He says since I was off for so long, he does not know how to handle this situation. And he has to find out how to handle it blah blah...

2. Then he says task X was assigned to me before my leave and it took 6 months and it should’ve taken me only 3 months because I am a very senior engineer blah blah... So he is counting in my legitimate time off for how long the task took.

My argument to #2 is: first of all, you cannot count in my time off. Secondly, if you were really a good manager and the task was an urgent one, you should’ve assigned it to someone else as soon as I went on leave.

It sounds like they want to use me as a scapegoat. And I am not protected by FMLA.

Anyway, what do you all advise? Is it time to find a new employer? Should I quit before the bad performance review comes out or after? Any advice what and how to write the self-assessment?

    I don't think it's necessarily time to find a new employer. It depends on what your other performance reviews have been like. If you're normally a high performer, then this is just a one off event and you'll likely be back to your normal reviews in the future. That said, I agree your manager isn't evaluating you fairly, and so it might be time to look for another group or outside the company. If inside, you need to do it before the bad review--lots of companies don't allow transfers after a bad review, but outside doesn't matter--big employers will only confirm your work dates sure to liability. BTW, your profile says Broadcom, was this at Qualcomm? I thought Trump killed that merger.

      I changed two jobs after the Broadcom job. A lot of people here on Blind that still use their profile from a previous employer.

      Good point about the internal transfer. It skipped my mind. But if I look for a new job, it’ll be external anyway. I doubt my transfer will go thru being at Qualcomm for a bit over a year anyway. This manager might block the transfer too.

      I guess I stick around until I find something better. This is not a manager one wants to work with in the long run.
