though the question below is quite obvious, at times many are confused if the answer should be yes or no. when applying got jobs, there is this one question “Will you now or in the future require sponsorship for employment visa status (e.g. H1-B visa status)? “, people who are already on h1b and has 140 approved, should the answer be yes or no? when one is looking to switch, will the new company have to sponsor? it is my understanding that sponsorship is for those who are not on h1b status and will have to go through the whole procreas of lca, application, lottery etc. not for people who are on h1b already. thoughts?

Yes. And the reason is quite simple. An H1B transfert is not a simple technicality. It’s a whole new application. Your new employer will need to defend that the job being offered to you is a speciality occupation, that you are competent to do it, that they have enough resources to pay you and return you to your home country if need be.
And if you change employer and still plan to obtain a green card in the future, they will have to apply for another PERM and do another I-140. You can ‘port’ an adjustment of status in certain condition. But that doesn’t apply to the other steps of a GC.

These days, many companies do not want to hire h1b due to immigration uncertainties and answering the question as “yes” puts you in a different bucket and reduces your chances of being considered.
