I am currently on my H1B visa. Have an offer from another company and going to start transfer soon. The issue being, i have to travel internationally for some family commitments and already have a VISA appointment date and submitted DS160.
Now the new company’s manager says you might not have enough time to ramp up before traveling, join after coming back. But if i have a work authorization with the new company as well and get my stamping done for my current employer, will that cause issues?

What of the three options is preferable?

PS: it is my first international travel after H1B lottery, but fortunately have a drop box appointment due to the pandemic.

  • Both 1 and 3 have downsides. On 1, let’s say the application goes into RFE for some reason, it would cause delay and your travel plans might get affected. On 3, it would be same scenario if it goes into RFE. Also, let’s assume it gets approved. Now, since you have a new H1B approved, it might lead to complications as visa officers should be able to check that the one which you are using to apply visa is not the latest and may lead to discrepancy. Hence, 2 would be the most safe option and I would tend to agree with your new manager. In an ideal world, both 1 & 2 should be fine but you would have to always consider worst case scenarios.

    Best option is to check with an immigration attorney if you happen to know anyone.
