moving to competitor with non-compete?

potentially moving from one backup software company to another. I do have a non-compete in a state where non-competes are valid. Is it realistic I get sued? I wouldnt be taking a book of business or poaching previous business. Seems that I see people moving between competitors all the time in this field. Also, how would my previous employer know? If I didnt tell them or update my linkedin? Thanks!
