I am currently on H1B and my PERM is not yet approved. Possibly will be filed next month if everything goes fine. I am not sure how long it will get to approve i-140 after the PERM approval.

Will the future spouse who would be on H4 can apply for EAD without my i-140 approved? And can they apply for the residence based on that?

What would be the best option?

    don’t do that to your fiancé. let her pursue her dreams, she’s clearly skilled. Don’t bring her to this shithole place that doesn’t value us Indians and make her give up on her career.

    If he/she has mbbs and ms and interested in pursing to be in profession (like actually practicing being doctor ) don’t come to usa , it’s waste of career. If they are interested in doing non clinical research there us a decent scope. If perm is not filed yet it may take atleast 18 months to get her ead on h4 .

    You do know the grind and the dozen hoops to pursue a medical career for a foreigner in the states right? You basically get the last preference everywhere irrespective of how skilled you are. That too in h4 ead, with about 20 -30 yrs to go for a gc best case.. she will have an amazing and lifelong career and status in India. If you really like your fiance, go back to India, have a wonderful life together and live like a king and queen!

    Sorry for your situation! Your fiancé will have to kill their career unless they decides to study here. They have excellent cred. and don’t do this. My friend was in a similar situation and his marriage was literally in verge of break up. He ended up going back to save his marriage and her career. They both are happy in India now
