H1B transfer and H4 EAD application

Apr 20 9 Comments

Hi fellow blinders,

I am on H1B visa. My I-140 is expected to be approved by August this year(1st time application). After that we are planning to file for my wife's H4 EAD apllication (1st time application).

Obviously, our priority is to start her career before elevating mine.

Should we wait for my wife's H4 EAD to get approved, before I change my job ? This might take March - April next year.

Or can I change my job after applying for her H4 EAD application, without waiting for h4 ead approval ?

Has anybody gone through similar situation ? Please help me out what is advisable in above situation.

Upgrade i140 to premium and fast track it.. if u change company after h4 ead applied , probably old company will revoke ur h1 and hence the h4 application will get rejected.. u have to start fresh through new h1..

Qualcomm doesn't withdraw i140, our immigration team has confirmed this in atleast 3 immigration all hands. Will this info make changes in my situation ?

Did you ask them specifically? Some companies do and some companies do not withdraw. The best option is stay put for 180 days and then move on

@Evn123 / @nspark .. If I do H1B transfer after her H4 EAD is approved. Do I need to go through all H4 transfer - I140 with new employer - H4 EAD application/ transfer cycle again ? If yes that would be worst nightmare scenario...

After cooling of (6 month or so) ur i140 approved, no body can withdraw it. If u move after h4 ead approved , yes all things needs to be restarted but ur wife still will have ead approval till end of of ur current h1 status..so no problem with changing ur job as long as u r in status.

Technically there is no need to wait once you have priority rate. But in rare cases they may revoke I-140 or deny H4 EAD if you are doing amendment with new employer. So better to wait .
