I've moved to US on L1B visa. I am confused if I should be completing W-8BEN or W-9. Could you please point me to some resources that could solve the doubt?
I've come from India. I'm on US payroll.
Fidelity displays this on the portal.
"Based on the information you have provided, you appear to be a U.S. resident for tax purposes and should complete Form W-9. However, if you are also considered a resident for tax purposes of a foreign country with which the United States has an income tax treaty, you may still be treated as a non-resident alien individual under the terms of the treaty. If you believe this to be the case, you will need to consult the specific provisions of the applicable treaty prior to completing Form W-9 or Form W-8. If you do not plan to claim residency in a treaty country, please complete Form W-9."
