Anyone knows what happens to pending i-140 and i-465 GC application if you get into Amazon pivot? recently i got placed in pivot and there is high chance i get laid off. Im currently on F1 OPT visa thats expiring end of the year and I’m not sure what are my options here or what happens to my pending application its been less than 6 months since it was filed #amazon #pivot #gc #i140 #i465
Do you mean you might be pip’ed? From blind posts, my understanding was there is no layoffs in Amazon But regardless I think you need to restart the process if something of that sort happens to you before i140.
I was already placed in pivot and took the plan and not sure if it’ll come out positive hence saying getting laid off
That's not laid off, that's fired.
You need H1B visa. If your PD is not current, there isn’t a possibility that you will get your GC before the year ends and you would need H1B to switch jobs. Approved I-140 on F1 does nothing for you unless you can get your GC before you leave.
My priority date is current issue here is if I get terminated while it’s pending what happens?
Amazon would withdraw it. Try to stick there if possible till it is approved. Ask the lawyer if you can pay for premium processing for I-140. It’s totally worth it. Otherwise look for a new job on OPT and start the process all over again.
FYI, it is i-485 not i-465. Did you already file i-485 application? If your i-485 is pending for more than 180 days and i-140 is approvable, you can change company without jeopardizing your GC application. If it has been less than 180 days, you might still be able to port i-485 if your interview is scheduled after 180 days. In both cases your new company will have to file i-485 suppl J.
If laid off without i140 need to redo process with new employer
How about if I received the I-140 before I’m laid off and my GC is pending? Are there chances I still get my GC? I’m not from backlogged countries and my priority date is current.
Yes you can keep your priority date but need to find a job . I140 still needs to be redone when we switch jobs
