serious reponses only ! please no troll. i have my i-140 approved at intel. i m planning to change jobs and move to a diffrent company. companies like amazon / apple would start the green card process after one year. lets say i moved out of the new company in 10 months and my GC process hasnt started at all. when the third company files GC, can i still retain i-140 priority date ? how does it work ?
Yes. You can still get h1 extension based on your i140 from first employer. When u file for new labor n i140, you just port your Priority date from earlier.
Thanks a lot 🙏... I was really worried ...and tensed a lot
i dont think thats how priority date works when u switch employer
What do you mean ? Can you pls explain
assuming your current employer that sponsoring your 140 doesnt revoke your application
talk to your immigration lawyer
If your i-140 is approved, why can't you just apply for i-485? If that's pending for more than 6 months, you can change job taking advantage of AC21.
I don’t understand ... isn’t I-485 the last step ? My priority date is still not current ... can you pls explain ?
@Pzd does not understand correctly. After i-140 is approved you need to wait for your priority date to be current. As OP mentioned PD is still not current.
nah. The I-140 with intel is like a life time contract. It would be an immediate denial if you try to apply green card with any other employers.
Once 6 months passes after your i140 approval, priority date can always be ported.
This is something that can be negotiated. Ask for the GC process to start earlier. And yes in most cases you can keep that date but the whole process needs to be started all over again.
Intel doesn’t revoke. I quit last year. You should be able to port your priority date to future employers.
