Wanted to start a list here for fellow Indians, of companies that will set you up for an EB1-C green card application, by letting you work outside the US as a manager for 1 year, to meet the EB1-C eligibility requirements. Please help me by adding to the list, if the EB1-C route is possible in your company.

A greencard is the biggest bottleneck in changing jobs, earning more, and progressing in your career, but Indians have an 80 year wait currently in the EB-2 and EB-3 pools due to racist per-country quotas.

I'll start with Google. It's possible, but you'll have to take all the initiative. You won't be supported at the company level, so it will very much depend on your management chain, and your relationships. Working abroad, and then returning back will likely involve changing teams (or at least subteams), and you'll have to build strong relationships internally over time to be able to do that. A blind team transfer might also be possible but more risky in my view. Recommended to be at least L5, but being a manager is much easier at L6, when team changes are involved.

GC status: Heading to Zurich next month, for a year or two. See you all back in 2024 hopefully. (EB-2 is already approved, since Google files day 1 EB-2. Unfortunately, it will be the year 2100 by the time I'll get a GC with the approved EB-2 application due to racist quotas, if I were to just hang around.)

    1. What's your level?
    2. Do you have reports?
    3. Do you plan to get reports in ZRH? If not, planning to come back as functional manager?
    4. Is moving to Waterloo and working remotely not beneficial in your case?
    5. What material is needed for G's EB1? I've heard of a word document being given to fill but not sure.. There was a question on visa-discuss@ about this document a while back someone asking about TL duty evidence

      I think PAs don't matter. As for the number of reports, I have no idea but I can imagine a racist USCIS employee finding excuses to reject you, given how subjective the approval process is. However, I'm not a lawyer, and you really should get credibility legal advice before taking the plunge. (Do note that many immigration lawyers are also incompetent -- I'm looking at you Murthy -- so find someone good and get their advice).

  • Many EB1 i140 are rejecting so there is no guarantee if you come back on L1 A you can file in EB1

    How long does it take to become a manager -before- you think of that international transfer?

  • I don’t have much advice for you except ask you if youve considered EB5 GC. With your TC of $600K, I hope you have a sizeable stock portfolio that you can borrow against to fund the requirements for EB5. In either case, I’m impressed by your hustle. Godspeed.

      I had thought about going the EB5 route initially. But EB5 can take 4 - 6 years to materialize. Based on my research, there is a significant chance of losing your invested capital in the process, with the number of shady EB5 "investment opportunities" that are around, and you'll have to be okay with losing $1.8M in the worst case. Especially given that laws will likely change in a six year time frame, and the probability of an anti-Chinese GOP in 2025 restricting EB5 investments to have a minimum threshold of $1M / 1.8M is non-trivial.
