EB3 to EB1

Starting a new job with a EY - USA as Manager next month. Currently on h1 and EB3 priority date is 2015.

Was just curious if I will become eligible for EB1 if I work with the firm for an year as a manager ? Or that 1 year has to be outside US? My title is Manager and I may/may not have people reporting to me.

EY TC: 175 in midwest.

    You qualify for an EB1 if you have extraordinary ability in your field. There are tons of managers out there. If this is your only strength, then the answer is no

    Not sure what you mean? Are you asking that if you are a manager in US you automatically qualify for EB1? No way..

    You have to work in India in for an year as manager and the company should file as internal manager move from india to US. You have go through new perm process and file an new I140. Check with your company immigration attorney they would able to guide you better. I am sure you have to work in India or other country as manager for an year. And you have manage people and they should show the org structure under you

    Here’s what you can do - ask your company to make you a manager outside US, then spend one year in that country and then you come back to USA on your H1 (you can also take a L1 visa) and you must work in a manager capacity in the US as well. You then don’t need to file a perm process because EB1 doesn’t generally need perm but you might need a new I-140 (not sure about that). I asked this question from my lawyer last week :)
    And if I were you, I would do this 100%, the EB3 PD of 2015 will get current not before 2030.

    EB1-C (I think) is only for international managers. So if you transfer to Canada or India for 1 year or more as a manager and then come back - all internal transfers for the same company - you can file under EB1.

    I never did it because I was too lazy but a lots of people have done this
