Curious whether anyone has had luck moving from a Federal agency to In-House without any law firm experience. I’m particularly interested if Federal sector labor & employment law (and lit) experience is valued or not.

  • I think it depends on what you do. Gov lawyers are super valuable in compliance - to build programs that comply with FCPA, BSA, AML, etc and defend against gov inquiries. Employment law experience is definitely valuable at a company if you’re advising on how to comply with parental leave requirements, Covid issues, performance/separation, etc.

I’m in the latter situation plus litigating before EEOC and other third parties. I’ve recently applied to some tech counsel jobs and want to temper expectations.

You can apply but youre definitely competing for a small number of positions where your experience is applicable. So possible but not easy.

  • I’d suggest targeting companies that are likely to have the type of employment issues you’ve been litigating. And also applying for employment law roles, but likely at a lower YOE range than what you actually have since it’s a new skill set.

That’s been my approach recognizing exactly what you’ve pointed out.
