Rejecting offer after H1B approval

Hi all,

I had an offer from Microsoft and they took much longer (5 months) to get my H1B transfer done. Meanwhile I interviewed at Google and got better package and level. Google is my dream company.

My MSFT start date is after 10 days from today. Can I still reject the offer given that my H1B transfer petition is done ? Will there be any consequences in terms of visa?

p.s. i am still employed at my current employer whoch is Yahoo..l i haven't resigned.

  • Since your transfer went to RFE with MSFT, you may or may not get RFE with google transfer...so, Inform MSFT that you will join after 2 months.
    Meanwhile let google do the transfer process. If it’s approved without RFE then inform MSFT that you are not joining by saying some bullshit reason that you are so worried that your transfer went through RFE and it may also continue with future extensions with MSFT so you are not comfortable in joining MSFT.

    You can have visas approved from multiple companies. You are good on that front. But not sure if it is ethically the right thing to do after accepting. Can you please throw light on your current G and MSFT offer

    You can have multiple approved petitions, once you choose to join a particular employer and fill the i-9 form, USCIS is notified on which employer you chose.

      I had a transfer that completed but I had to reject for personal reason and I didn't resign at Amazon. It wasn't a big deal.

    I think safest option is to start Microsoft and let Google start your Visa process. You can control your Google joining date and Visa timeline. If I were you I would have worked for couple of weeks in Microsoft to avoid any Visa and ethical issues. You kept your words with MS.. it's ok to leave a company in 1-2 months
