I have an E5 offer from Facebook and am waiting for H1B transfer. My lawyers tell me my case is strong and I can join on receipt. If I choose to join on receipt, I could join before Dec 31st. If I choose to wait for approval the start date would be in Jan.

How safe is it to join on receipt? How does Facebook handle RFEs or if H1B is denied? Do they move you to a different country until the dust settles?

Also, worried about losing the stock refresh if I join in Jan. Is it pro-rated or absolute?

  • Is your h1b transfer already filed? FWIK dec 9th is the last bootcamp date in this year. If your transfer is already file you should have a approval by then. Premium processing hardly takes 10 calender days though they officially say 15.

Having said that I would never take a chance to join on receipt given the rate of RFEs and subsequent rejections have increased lately.

Yes. It has been filed on 22nd Nov.. Waiting for receipt confirmation.. I am wary of RFEs too but at the same time I don't want to be stuck for another month and lose pay while at it..

    • Hmm. I think you should likely receive your approval before 9th dec. If not it totally depends on your risk appetite. If attorney says you can join on receipt he/she should be telling that based on past experiences. So its likely you will get through. But there is always a remote possibility of getting rejected in which case you'll have to relocate.

  • RFE is at least 3 extra months

    • I went through RFE before and HM waited almost 6 months for me. I lost a lot of money bc of it but it is not worth taking the risk. The result will only take 15 calendar days. What’s the rush especially during holidays? Just wait for it. The risk is higher to join before approval if got RFE

Why risk it dude? Get the H1B approval and then move. For a few $$ you’re risking a lot more. In the long run, you’ll make it up.
