DHS is proposing to rescind H4 EAD. My spouse is nervous about losing the job and I am exploring other options like migrating to Canada.

Would like to hear from others in the same position.

  • Good riddance. I get why the H1 program exists but the H4 employment authorization is pure bullshit. The only qualification required is being married to someone on a temporary work visa. Give me break, either you are highly qualified and can get a visa of your own, or we don’t need to make an exemption for you and you line up with everybody else.

  • Inb4 posts saying that all spouses of H1 holders getting jobs was unfair, let me tell you no, that's not how it works. You need to be on your H1B and you should be sponsored for a green card, and your green card process should be in the approved i140 stage to get the h4 ead. On an average, getting H1B and then i140 takes 3 years. If you have done a masters like many of us, add 2 years. So a person who had contributed to this economy for 5 years does not even get the right to see his spouse be legally employed, pray tell me what is fair?

  • This affects mostly women - women who are denied permission to participate in the work force, as their spouses are stuck in decade-long GC backlogs. It is amusing to watch the silence from the crowd who, rightfully, were angered at the Damore memo.

    I guess speaking up for legal immigrant women don't have the same virtue signalling benefits :)

  • For everyone who are against h4 EAD, what are you not speaking anything about L2 EADs? L2 EADs are ridiculous. For h4 EAD, the h1 should go through green card process and have approved i140. But for L2 EAD, no such control. A person comes on L1 and next day the spouse applies L2 EAD. Why so? We should ban L2 EADs as well. *We should do so at least for the L1s from South Asian countries*

    To everyone posting condescending comments, I got married in 2015 and my spouse was able to work from the start. Suddenly that has changed. I am not questioning the change as much as I would like to. I am just looking for alternatives.
