Got an offer from LivePerson in Bay Area Offer details: Base: 170k Bonus : 10% RSU : 250K over 4 years Total: Around 247K I have around 1 year 9 months remaining in my H1B and my company has already started my GC process. I am currently in wage determination stage. PERM should start by April 2022 which might take 7 months to get approved. My concern is that if I switch jobs and if my i140 doesnt get approved before my H1B expires, I would be out of status as I would need PERM to be filed > 365 days of my H1B expiry to extend H1B by 1 year which might noy be possible if I switch. Any thoughts on whether I should stay and wait till i140 approval or switch? #tech #greencard #i140
I recommend you stay until the I-140 is approved. Not worth taking the risk no matter what the TC is. It is taking on average of 16 to 18 months until you get the I-140 approved with premium processing without getting audited. I was in similar situation. You are so close. Once you get the perm approved then I-140 takes less a month with premium processing. Think about it and decide what’s best for you. Nothing is more important than status.

Yes, lot of stress. Once you get the I-140 i don’t think you need to wait 180 days even thought that’s the rule. But most of all the companies don’t withdraw your I-140 even if you leave before 180 days. I know its hard to miss on the offer and RSU’s but check with the new company and explain them your situation to see if they can wait.
