H1B transfer+extension during H1B extension.

Hi all,
Currently I am employed with Emp-A and work for a client in EVC model. My current H1B is going to expire by end of Feb. As time is closing in, my current employer is requesting documents and details for H1B extension. At the same time I have an offer from Oracle and they are in process of filing my H1B transfer+extension. Currently they are in LCA preparation phase but it is very slow due to BAL and holidays.
So I want to know if we can transfer+extension to Oracle when my extension is in progress with Emp-A. Are there any complications?? In case I don’t file my extension with Emp-A and if there is a RFE/reject for OCI then I will be out of status. Pls suggest.

Current TC: 115K or 🥜
OCI TC: 170K

    No complications. Push BAL to file transfer asap and also file extn in parallel may be a week or 2 after. I would make sure to file transfer first and extn after that. Reason, in case if you receive rfe for extn they might give an rfe for transfer to submit proof of extn approval. Happened to a friend recently.

    There’s nothing called transfer. Both your current employer and new employer will file for extension. You can have any number of active H1 petitions but can work for only one.

    The reason your new employer asks for previous 797 is not to “transfer” its to show USCIS that you are cap exempt.
