Regarding H1B transfer

Dec 12, 2021 9 Comments

Guys, quick question for my friend as he don’t have blind account so I am asking on behalf of him. He got offer from from company B and company B transfer his H1B from company A through premium processing. But in a meanwhile he got better offer from company C in terms of role and compensation.
So should he join Company C as his H1B is already transferred to company B, if yes does it impact anything in future for green card application or H1B visa interview anything like that.

  • Yes- it usually does mean burning the bridge at least for the next couple of years. Very common for recruiters/hiring managers to leave a note on how you promised a start date, made them undergo the entire transfer cycle and then deserted just because you got some more $$ elsewhere. This wears off over time as people move/time elapses. But likely you won’t be seeing them reaching out for the next 2-3 years.

  • Doesn’t impact anything. You can have multiple transfers at a given time

Did company B filed transfer? Even if they filed, legally you are not responsible. I would say don't think much and just move on

You just cost them $8 to $10k - legally are you responsible ? No - it’s an integrity issue - you just wasted the time and money that they could have spent on someone who wants to work there

Building a career isn’t just about how much you get paid - it’s about building skills and a reputation in your given industry / field of expertise
