I-9 form for h1b transfer

Sep 20, 2021 6 Comments

I am moving to Google and my h1b transfer petition is approved and I am waiting for the physical copy. My new employer asked me to fill out I-9 form but i dont have the i-797 physical copy yet. Can I use my current employer(DoorDash) I-797 form to upload the document on section2 and the expiration date on sectionc1?#workvisa #h1b

You might have already resolved this by now, but adding here in case someone searches for this. I was in the same boat and I confirmed with the i-9 team that the previous employer's i797A along with the email approval notice that you would have got for new employer would work.
Could you please update here when you receive your physical copy, and how long it took after the approval date?

I selected option 2. They haven't gotten back to me yet but I would imagine that a screen share or even just forwarding the email with the e-notice attachment would work.

More info in case it's helpful to others: just got done with the i-9 verification. I was asked to show 2 documents via the webcam - the passport, and the i-797a from my previous employer. They didn't even check the details on those documents - whole thing was over in under a minute. But was told that when the offices reopen, they would need to see the physical copies.

No you should not. I797 is tied to employer. The expiration date also would vary I.e you will have a new i94 in your new i797 that matters. You must atleast have soft copy of the document.
