Asking on behalf of my sister, She is on H1b: She got laid off in 2023 and rehired on the 60th day of grace period, Again today she got laid off from another company. So my question is how the grace period works? I'm asking attorney as well, but does anyone have any information on this? Thank you!
She has another 60 days.
If the h1b was transferred, the grace period resets to 60 days
I think this is not true. Imu they typically do not receive an additional grace period if they are laid off in the future. The 60-day grace period is a one-time provision to allow the individual to find new employment in the United States after losing their job.
Google is wrong here
Hope she is doing well. It must be very hard on her to bear the layoff twice.
Also, within 6 months of duration
Been there. Done that. It is awful. 2 layoffs in 5 months. My sincere sympathy for your sister. Trauma is real and if you can support her, and looks like you are, do all you can. It will leave a lasting impression on your mind about your good qualities, and she'll hopefully come out of this rut with a good job too.
Thank you all for the answers, it helps a lot!
Better ask this question on r/H1B subreddit
can you please name the company if you don't mind ?
Send her to Grace Hopper Conference pls
How does that help ?
GHC is only good for new graduates.
I can confirm That the grace period resets with every petition. She should be good to go
Another grace period of 60 days
Imo if it's not same company where you got laid off 1st and used any grave period, you get 60 days grace period again.
