140 visa - offerletter not turning to employment.
I am on visa with 13 months in hand with no 140.I had couple offers from CVS,GAP, Nordstrom, McDonald and few more not from faang companies. Problem : Every company said they can get approval for 140 with my given time lines before interview but after once offer is released or about to release and when I submit my documents for visa transfer they say we can hire you but can't promise on 140 and we may terminate after 13 months if 140 not approved. What are my options. I am currently working for big consulting company wh started my 140 process 2.5 years back still gng on... I don't no when will this end. I was here bcz this company started the process but regret my decision to stay here .. looking at this pace they will easily take another 1-1.5 year more. Frustrated.. what are my options now.. If you can prove that your company is pursuing GC you will get extension on H1B (typically 12 months)
You should have perm filed 365 days before 6 year H1b max period to qualify
Okay.. so once perm approved can i transfer it to other company and let other apply 140. Bzc the current company am with will not fill 140 immediately.
Nope,you can’t do that,you need to have i140 approved
😤 this law is in favour of company. We can't file premium 140 individually with out depending on company just googled. So I have no other options other than trust current company. Thanks man for your reply. I thought there would be some or other way to get of this situation.
I’ll be in your shoes soon unfortunately 😞 Curious to know why is it taking so longer for you at your current company ? And at what stage are you at in the process as of today?
I have no clue they say pwd bla bla for 2.5 years recently filled perm waiting for the results(3-4 months).. if it goes for audit I don't no when it will be cleared. Even if cleared this guy will not file it in premium. I am getting 3x more salary out .. getting close to max out .. all self chosen hell.
Has your current company already filed for perm? If so i would stay and then switch once it is approved
Yeah they filled it. Also m not happy with the process which is taking years.
Perm should be approved in like 6-7 months
