Backing out before earnest is paid

Wife has 2nd thoughts on home but we presented an offer and it got accepted. Can I just refuse to pay the earnest and backout?

She decided she doesn't like it. Doesn't matter what I feel. It will destroy my relationship to buy. Any consequence of just not paying earnest and backing out or should I try to use other contingencies? It's still within attorney review stage so I guess I can just ask lawyer to discard it?

You can back out. No harm no foul. Once you pay EMD, you can only back out if you have contingencies, which can be more tough.

Thanks. Primary reason is some risks with HOA. I'm verifying with lawyer though.

Attorney confirmed that during attorney review period we can backout no problems. Nothing sellers can do and even if we paid our deposit it would have been refunded.

Yes. In any case the seller agent will not mark the home pending until something is final. So business as usual for them as well
