So last month I rented a room in a warehouse type place in the mission for 1700 a month and signed a sublease until September. It was a room in a 6bed 1bath in the mission district of SF. I know it’s a bit overpriced but I really liked the aesthetics of the warehouse. Paid one month rent and one month deposit up front When I moved into the room on April 2nd there was still a disgusting woman sleeping in my bed.. she was clearly on drugs and took a long time to wake up. After I woke her up she fell a couple times and then stumbled out of the room. One of the housemates later told me that it was the previous tenant who snuck back in, and also that she was a prostitute who “frequently had men over” I didn’t feel comfortable sleeping on the bed after that and slept on a couch for a couple nights and then mostly slept at my boyfriend’s place. A week later had already rented another place in the mission so been paying double rent for most of April and probably will be for all of May assuming I don’t get my deposit back. I told the tenant I was subleasing from on April 4th (two days after I moved in) that I wanted to break the lease. Helped him try to find a replacement for the rest of the month (found one who was interested but the housemates said no) and in that process found that he’s been trying to replace previous tenant since February (even though they acted like the room was in high demand when I looked at it) and also that he didn’t lower the price at all after COVID so he “wouldn’t lost money” he also refuses to lower it now while I’m renting it out even though there is no demand making it impossible to rent out and get my deposit back. The person I’m subtenanting from has been in NYC since covid started and subleasing the room Is it a dick move to charge back my deposit on Venmo? He’s made it clear I’m not getting the deposit back but I was only in the room for two days and if I hadn’t rented it out I’m pretty sure it would’ve just been empty this whole time anyways. Also I do have a lot of mutual friends with the lessor and don’t want to completely ruin relations TC 400k since people are going to ask 🙄

Honest feedback: It sounds like you got taken advantage of and are too nice to realize it or do much about it. I would be doing everything up to legal action to get every dime back. Someone was living there when you were supposed to move in. Not okay.

Hey, this situation has really escalated now and I’m thinking about going to small claims court. Does the prostitute legally mean anything? As in does it legally make the property unlivable? I noticed on my contract is says technically by moving in the first day (even though I moved out the day after) I am implying that the room is in livable condition
You want to be cheap and live in a $1700 place this is what you get lol
If chargeback doesn’t work, go to small claims court if you need to. No lawyers and easy enough. I did that and won against a sketchy sublease situation in the mission a couple years ago. Covid probably has made for a backlog of cases though.
