[Please help 🙏] H1B PP got RFE, Fragomen are not doing their job?

Hi all, I would appreciate help from people who have filled H1B/H1B transfer by Fragomen, or huge law firm. I have been keeping up to the H1B thread and thought that I need help so I created a new post. I am posting using my friend's Blind account. Quick details* Date of submitting Fragomen questionnaire: 3/25 Date of filing with USCIS: 4/16 Date when receipt was generated: 4/17 Date when RFE was mailed: 4/25 (checked on egov, have not heard back from Fragomen) Current company: small startup New company: Cisco Yoe: 2 Role: Design The time that I saw how my petition looks like is when Fragomen sent us a copy of what was mailed it to USCIS on 4/17. After I saw the copy, I was very concern about the initial petition not attaching my resume, my title is Technical Staff (not even have a word of designer), scanned passport/visa photos are not viewable, specialty occupation are some bullet points talking about working with engineers and pms, not really about design design. I have faith in a big law firm that I could trust, at the same time, they did not even attach the files that are important in a sense that if you google, you can find what other 100 lawyers would say should attach a resume. I am not professional in the field of law but I crafted my initial H1B Petition letter for the current startup, understanding "if I am not in tech but an officer looking at tons of petitions every day, what files and petition letter would convince me" and it got approved in one go. Can anyone who filed through Fragomen tell me whether they have a similar experience like did not attach important documents? I would love love love to see an outline of what Fragomen help filed in the petition, so I know what to bug the Fragomen Cisco lawyers for. Thank all a lot.

Sorry to hear that. Fragomen applied for me last month, got approved. Could be a particular paralegal not being diligent. Follow up with them and voice your concerns, copy your HR/recruiter

You don't even know yet what the RFE relates to. No one is going to be able to comment in a constructive way without details on the RFE.

Also, I'm not sure I buy your claim that a resume should be attached. USCIS will never use an unofficial document like a resume as a reason to issue a visa, but they MIGHT go through it and find reasons to reject your application. So I don't know why other lawyers would attach it. No doubt some do, but why? USCIS will apply the law, and base their decision on authoritative documentation. Also your resume probably does not write up your prior experience in the legalese way that needs to be used, and may contain imprecise language that hurts your application. If USCIS want to know about your previous jobs they will want the official job description, letters from your prior manager, and other verifiable evidence. Best practice is to give USCIS precisely what they request and nothing more, since anything more just gives them more excuses to RFE.

No, I came through a different visa, and then went through GC process, but the principle of giving USCIS exactly what they ask for and nothing more was drilled into me by my lawyers through both processes and I can't see why it would be any different for h1b. If they don't ask for something, don't give it to them. It won't help and could hurt.

You should raise this concern with thr HM and/or recruiter so they know the lawyers are not doing a good job I did the same

I got my RFE They took3 weeks apply and then 2 weeks to inform me what the RFE was about so i made sure i inform my HM on the timeline and the delay caused by them. Just shoot an email to your HM saying that the attorney is causing a delay in the process that can potentially push out your joining date

1) job title relates to your SOC code for LCA which has to match your roles and responsibilities 2) the job responsibilities are given by the HM to the law firm. If RFE is for specialty occupation, you will have to work on #2, make sure to work with your manager and make it sound complicated and technical. Also make sure to match with the SOC code used to file LCA PS: all law firms suck these days. They know in current scenarios, they can mint more money by creating extra work and pretending of taking their won sweet time to get shit done.

My job title and soc code are completely different from my H1B petition and this transfer petition. From Graphic design to industrial engineers. (I am not even an engineer 🤔) I have no idea why they file under this I am waiting for the response of RFE reason. I will definitely keep in mind and communicate with my HR and manager.

Its not about just the title. As long as the roles and responsibilities match with SOC job code description, its good. But if you change soc codes even on h1b, thats causing rejections. Its better to get the RFE and try for outside consult with another lawyer. But many law firms dont share the complete rfe and then no one from outside council could help.
