I am moving to a complete different role within the same organization. H1b amendment would be needed. I am yet to speak to my current manager about my internal transfer. Do I need to wait until amendment is approved before I move or I can join right away? Please post your experiences. Trying to get an idea about the timeline to discuss serving time in my current team.

- You’re supposed to stick with your current position. Moving between positions while on H-1B is a big problem. It’s only three years.
This maneuver, by the way, is how companies cheat the visa system: get a visa approved for one job and then try to switch up the job.
If you attempt a transfer like that, then good luck not getting your visa revoked.
- Yo. First of all h1b is not for 3 years. It is for 6 years. If you have an approved i140, you can keep getting it extended until you get green card.
Moving between teams is completely ok and legal. Read the h1b amendment rules on USCIS website. When a candidate decides to move to a different role within the same company, they just need to file for h1b amendment. My question was if I need to wait until h1b amendment approval or if a receipt is enough. Not all H1B’s are fraud. We graduated from good colleges in the US. And we STICK to the rules.

My bad about switching teams. You can switch teams without problems, even if it’s in another city.
When you move to the other city to join the new team just let USCIS know directly you moved. You don’t have to tell your employer. USCIS will reply with an acknowledgement and they’ll even contact your HR department for you. The letter may come from the DOJ but that’s expected. No worries.
