Car crash

I had an accident today due to a car making a sudden u turn from my right lane. Fortunately everyone is safe. The other guy had no insurance no license, had his license suspended 3 times and was looking high. Cops said that I’ll have to call my insurance and its their decision if they want to pursue this guy for the damage. Has someone been in a similar situation? What options do I have to avoid/reduce costs incurred in this. Front bumper of the car completely smashed.

Not much you can do. You have to call your insurance and they will have to pay. It is up to them if they want to go after the guy.

His car’s front tire was completely bent.

Let insurance take care of all. You provide with all info and police report. Make sure they don’t mark anything negative on your record.

They didn’t and said I was not at fault.

You will be fine, just got to go through insurance follow ups!

Do you have uninsured motorist coverage? Your insurance will likely pay for damage/injury through that coverage and especially if the payout is large, they will very likely pursue (namely file suit against) the other driver. If you don't have that coverage, you're likely on your own to recoup costs - if they're a deadbeat, your legal costs may exceed what you'd even actually recover from them.

Your collision coverage will pay for anything over on the car itself and if you have a decent health insurance that will cover your injuries. That still leaves anything else you would count as damages like medical deductibles or missed work

Thank god I do have uninsured motorist insurance!

That sucks, go after him. Negligent 100%, if you let it pass there will be other victims in the future. Speak up! Civic duty.

How can I? Should I engage a lawyer?

Atlassian Luffy, M.D Oct 28, 2018

Worth talking to one, but no guarantee they'll take the case on contingency - can't get blood from a stone and all that

One of my friend went through same situation.. in the end because the other side being uninsured, my Friends insurance covered for repairs but didn’t increase any premium.

Amazon Chad🕶 Oct 28, 2018

Your insurance should cover it, minus your deductible. Unless you were cheap and don't pay for the coverage of when the other person doesn't have insurance

Call ICE

Valorem Trynasmash Oct 28, 2018

Your insurance will cover it just get a report saying your not at fault and it won’t increase your premiums, specially if it’s your first accident.

You could sue the guy in small claims court. However this takes a lot of time and from what you described, he probably does not have the means to pay you. Also small claims court costs a few hundred dollars that you would have to pay up front. If you win, the other party is supposed to reimburse you those costs...if you can collect
