H-4 EAD is executive overreach by Obama. His big gambit about “comprehensive immigration reform” fell flat, and the courts told him to fuck off with his DAPA. After spending 7 years doing nothing for high-skilled immigrants, the Democrats became unpopular in that community. So in typical Democrat fashion, instead of actually fixing the problem, he offered breadcrumbs. If the legal immigration system stays broken, they can use that as a reason to fix all immigration including giving citizenship to the illegals. So, of course, they would hold back skilled legal immigrants, in order to fulfill their agenda. I prefer the Trump approach. No bullshit executive actions. Let Congress decide, and fix it one way or another - either by making people leave, or by giving them permanent status.
FB can’t give that as a reason, H4EAD are still legal work auth, till DHS rule is out, commented and accepted
Palo Alto Networks said they’re not interviewing H4 EAD candidates for non tech roles, late last year. Other employers could do the same.
Could you then sue Palo Alto Networks on some theory of discrimination, say under Section 1981? This is not too different from some employer saying “we are not hiring DACA people right now”. Even if the program is cancelled, individuals will likely be still be eligible to work until the expiry of their document.
H4 EAD is still good. But it can take up to five months to transfer. So you should switch over from your OPT to your H4 as soon as possible. If not, if you get an offer from FB, we might have to push your start date back. You should get going on it so there’s no trouble
Apparently she applied for two jobs and one of the HR said that as per the recent policy change they are not accepting H4 ead candidates and other HR was fien about it and now she is confused
The recruiter might have not understood what H4 entails. Our rules recently switched so that you now have to have 24 months of OPT. BUT H4 is fine. You should have him/ her reach out to the recruiter and explain what H4 entails
You have to have 24 months work authorization to be eligible to apply? I’m on stem opt and only have 13 months left, earlier interviewed with fb, I didn’t get the role but recruiter didn’t even ask about my work authorization when she reached out, I guess she was assuming I’m on H1b or something?
All companies will do that very soon too !
