In the USA, by law companies should only verify dates of employment, title, and if you are eligible for rehire in their system.

If any more is shared and it gets back to you they could have a nasty lawsuit.

Thanks for the information. What does it mean to be eligible for rehire in the system? Can you be eligible for rehire if you were Piped out (managed out on performance grounds)?

      Likely not eligible for rehire

Generally if you are let go off ‘with cause’ firms mark you ineligible. But if you are part of mass layoffs, you will be marked eligible for rehire (basically fired without cause).
Poor performance may / may not be a cause by firm’s policy - they may decide to keep it without cause on paper, so you the terminated people get continued medical insurance in employers plan and don’t sue them for something that’s hard to prove for either side.

@xis, your statement is factually incorrect.

Saying not eligible for rehire means probably blacklisting. No company wants a lawsuit at hand. They will not say anything about rehire eligibility if you got fired. Your termination paper will say that.

Thank you. Can that termination paper be shared with future employers?

No. It will clearly state that it has to remain confidential.

If they correspond strictly via letter or email they will keep it legally sanitized. However nothing stops the HR from picking up the phone and calling to discuss ‘informally’.

If an offer gets rescinded, you can ask for the reason. A lawsuit can be at hand.

They will just verify what dates you worked there and your titles. That’s it.
