Planning to switch jobs soon. while I'm at it I want to plan some time-off/vacation before I join another job. A. Is it allowed to have a gap of few weeks between jobs while you're on H1b? does it cause any issues later during stamping interviews or during GC interview? B. If it's allowed, is it possible to travel outside the country? What do you say at immigration? will be great of someone who has done it can share their experience. TC: 200k Yoe: 3.5
I have done it. Don’t travel outside US you will never know when they do these extra verification like calling ur employer. You might need latest pay stubs incase the immigration lawyer requests them. So 2-3 week gap is fine imo
There is 60days unemployment period for every H1B. Are these vacation days deducted from the 60 day period of unemployment?
The 60 day rule is per employer. So for eg when u transfer from employer A to B you get another 60days but for some reason you want to go back to employer A after 30days you get only 30more days within that I94 period.
Try asking previous employer if you can take PTO for the time of your vacation. That way you would be on payroll and travel etc.
PTOs are usually consumed while you are interviewing :)
You should absolutely consult a lawyer, not take anonymous strangers’ opinions on the net. 😬
<2 months is okay but make sure you dont leave country
