So now that premium processing is suspended till February, I am confused regarding how is everyone planning to change their job? Let’s assume worst case scenario that someone gets kicked out of their job and now have 2 months to find a new job and they do get an offer. But h1 b transfer will take 6 months so after 2 months will they become out of status ? How does this work ? Any insights ?
True that Approval for H-1B transfer will take around 6 months. But, you can start working for new employer as soon as the new employer files your petition. You don’t need to wait for the decision. However, joining on receipt can be risky if transfer petition gets denied in the worst case
I think whenever premium processing opens up transfer can be upgraded to premium, so technically it should not take more than 4 months..but waiting for 4 months is still a long time and what if after 4 months the transfer does not happen? I think its better to apply in companies that help transferring to another country...
The safe solution is get an offer, apply transfer. While waiting, still work in the old company. Only quit when approved. A few of my friends are doing so. Almost zero risk, as long as the new company is willing to wait.
It doesn't apply to the worst case you mentioned - kicked out. But... What's the chance of an employee get kicked out ? I never know anyone personally.
you can quit your current job until your h1b transfer get approved.
There is not always this option. As mentioned worst case you get kicked out before you h1b transfer so now what?
move to other team, Or you can move once you got H1B transfer received notice. It’s legal, but you have no other good choice, right?!
