H1B transfer before Oct 1st

Has anyone done an H1b transfer before Oct 1st.My H1b is approved and i have the receipt notice.The H1 B was initiated be company A and now I want to move to company B.

      You can only apply for H1b transfer while you're in H1b status, which is not before 1st of October.

  • Hi @CIBER, thanks a lot for your response. I was concerned that I might need to be in lottery again if I transfer to new employer before 1st oct, but that's not the case, right?

      To my knowledge, you are cap exempt so long as Company A does not withdraw your petition before October 1st. I would still post your question on quora to get the right answer from the experts

      The start date he got was oct 1st. Your h1 will be starting with your new company if it is approved before 1st otherwise with your old company. The transfer process took 2 months after he applied. This was last year.

      Keep in mind, your old employer should not withdraw your h1b until oct 1st even though your h1b is approved with a new company!

    I would also suggest that you post this question on Quora as opposed to Blind since quora has a lot of members who are former uscis employees or immigration attorneys. They will be better equipped with the complete knowledge of all rules and the ever changing procedures. Processes have changed vastly over the last 2 years. So one person's positive experience will probably end up being your nightmare.

    Company B can initiate a new H1-B on your behalf. If you have already cleared the CAP, you will be filed in the CAP Exempt category. The process gets complicated if you are outside the US

    Just to be clear. There is no such thing as a H1-B transfer. It is a new H1-B petition by a new employer and subject to the same level of scrutiny as all petitions. The only difference is the you don't go through the CAP(lottery) again.

    Once a H1B is approved, you can transfer it anytime you have another sponsor ready to file H1B transfer.

      Because before 1st of October you are not in an H1b status, hence, you can't amend/transfer it. It's quite simple and well discussed already, really.
