When I switch employers and have my H-1B transferred and the new company processes my green card application for me, what documents will I need from my old employer? Specifically, will I need a signature from my current manager on any documents? I am not on good terms with my current manager (and that’s why I plan to leave), so I fear he will not agree to sign any immigration documents for me when I leave 😞
You have an approved I 140 now?
Yes, I do
Did Amazon give you a copy of the full I-140 petition other than the approval notice? If so, look for any letter from Amazon. That's usually good enough. If not, I'd recommend not getting a letter right away since you never know what requirements the future sponsor (the next employer) has and it's likely your manager has a grudge and wants to feed the ego. Has it been at least 180 days since you've had the approved I 140? If so, the worst case scenario is out of the window (you're eligible to get H1 perpetually until your priority date becomes current, assuming it's going to be a while). So if you're at I-140 + 180 days, then just don't ask anything, when the next emp starts I 140 contact Amzn HR (I'm sure there's a process for that) and not your manager. They should give you the letter. Is your 140 entirely dependent on Amazon experience or did you get a letter from someone else to supplement Amzn's 140 filing? Also, Bachelor's or Masters?
All you need is an ‘Experience Letter’ stating your job duties and your time in the company on a letter head. Your manager and Hr can sign that.
Will you qualify for EB1, EB2 or EB3?
EB2
Then if that would be an exceptional ability basis, you might benefit from a letter signed by him. If the basis is an advanced degree you don’t need him potentially
Get the letter from HR
Get a letter from HR before I leave?
Easier that way. I think it's self serve on inside.
Any letter from your manager or your supervisor(you can also get from co-worker) but it should have your job role and detailed responsibilities. If you can get it from company letter head or you don’t have to.
I 140 apps with unofficial letters are getting bent down and f-ed these days. May be the last resort...
Do we get the original i140 approval notice? I just got an uploaded copy of the same.
I only got an uploaded copy too, and I was told the employer retains the original.
I 140 original approval won't do anything additional that the soft copy can't do, so there's nothing to worry about.
