I am on H1b and considering switching companies. What’s the typical timeline to get the new I797 and I140 approved? I am a little worried to give the notice before having both documents as the 140 would affect my wife’s EAD. Has anyone done this before?
H1b transfer in premium processing should take 1-2 weeks. If your I-140 is filed by your current employer and hasn’t been approved yet then that process needs to be restarted in the new company. I-140 might take 6-12 months from when it’s filed depending on various scenarios.
My i140 was approved at Facebook more than a year back. How long would it take to get the new 140?

I believe u’ll need a new I140 once you switch companies. Your current I140 was applied for the specific designation in your company. Once you switch companies, you’ll have to apply for a new I140 that justifies the skills that are required for that company. However, the current approved I140 only confirms your priority date, the date when your application becomes current. Your spouse’s EAD will be unaffected as long as your visa is valid. Although i’m not sure if she’ll be able to renew her EAD given the current situation about terminating H4 EAD’s
H1 transfer = H1 extension + H4 extension + new H4 EAD application New I140 will be needed with new company to further GC process ; not needed for continual H1/H4/EAD extensions - only caveat being I believe that the I140 should not be withdrawn within 180 days of approval
