I am planning to leave my current job where I have worked for 3 years for Microsoft . I read that for L1 the requirement is 1 continuous year of employment in the past 3 years. If let's say after a year, I want to apply to a position in Seattle/SF, will I be eligible for L1 visa even when at that moment I won't be working for any subsidiary of Microsoft?
Yes, you will be eligible for an L1 for Microsoft. My ex-manager in IDC has already gone through the same.
Op is asking whether eligible for L1 if not working for MSFT. So the answer is NO.
I mean later if I want to work for MSFT only.
You are eligible for an L1 if you have worked at a foreign subsidiary for 1 year in the last 3 years (not including any days you travelled to the US) when employed as such. Also do note the count of 3 years is from the day you enter the US not when you get the L1. Check again but this is how it was 7 years ago and I know a person got the L1 even though he was working for another company but has met the 1 year requirement.
The regulation is what it says. You don’t have to be employed. You need an offer. Then msft lawyers will work with you on the l1 application package. And then you need to convince visa officer and us border protection officer that the company needs you and you are unique to the position.
To qualify for an L-1 visa, the foreign national must have worked outside of the U.S. for an employer for at least one year within the three years prior to transferring to the U.S. That is, the L-1 foreign national must establish that he or she has (1) worked for at least 12 months prior to transfer for the foreign affiliate as an executive, manager or specialized knowledge employee; and (2) will work in a similar capacity in the United States.
Hi do you anyone who has moved to a previous employer ?
Were you able to join MSFT SF/Seattle finally from a different company ? Did you join IDC first and then move internally in few months ? Or Did you move directly from a different company in India to MSFT US without joining MSFT IDC ?
I fall into same category that op has mentioned. I’m expecting an offer from MSFT US on L1, but I don’t currently work for MSFT. Any idea will it be a direct US offer or a dual offer where I will be joining MSFT India office first and then moved to US ?
Can someone please help ? I call under same scenario as op.
No
