But if it was because they found you had previously committed a felony, then yeah that would be harder to justify your current status is validly held.

With the free flow of information that system is easier to copy. The main thing that the US has that very few outside have is land and natural resources. US will have that advantage for a very long time. But other nations will adapt (like China did) and rise. Anything else that US has including IP, machinery, capitalism, etc. can be and will be copied. When that happens foreigners will not care about coming to the US. This kind of protectionism is a short term blip.
If you apply for change of status when you are out of status has always been very risky because if your cos is denied, all your pending period in the US is considered illegal presence, which can be used as a reason for deportation. This is nothing new and always been like this. So when my F1 OPT was ending and need to change to H1B, I traveled back to my home country to get H1B stamped at the US consulate instead of filing change of the status in the US. The people complaining need to learn the American immigration law. The article is based troll as law-abiding immigrants won't get deported.
How would you go about changing employers? Did you face deportation if your h1b transfer was denied? Assuming your current petition is still valid.
If you would've applied for change of status, from f1 to h1 and it got denied, they wouldnt send you a notice to appear in court. They would just say "denied". Then you could follow the law, and apply for f1 opt stem extension and wait another year to reapply for COS to h1 With this, even if there are legal avenues like stem extension for you, they still send you a notice to appear in court and prove that you are still legal. Should an individual constantly try to fucking prove to this incompetent government that everything is fine or should they actually go and do something in life? This situation gets worse when you have kids and 10x more documents later in life
I think this article is inaccurate. If you apply for an immigration benefit and it is denied, deportation proceedings will start ONLY IF you have no other legal status. But the article does not make that distinction. So if your green card is denied and you still have valid f-1 or H1-B or other status, then you’re fine. You may be deported only if you become out of status as a result of the denial.
Because that is mentioned on the bottom of p.7 of the USCIS policy memorandum linked in the article: “USCIS will issue an NTA where, upon issuance of an unfavorable decision on an application, petition or benefit request, the alien is not lawfully present in the United States.”
